MAGIC SHOW TERMS OF SERVICE & CANCELLATION POLICY

BY BOOKING A BRETTSO THE GREAT PROGRAM YOU AGREE TO THE FOLLOWING TERMS OF SERVICE & CANCELATION POLICY. THIS POLICY ONLY APPLIES TO SHOWS WHERE A BO0KING FEE OR FULL PAYMENT IS REQUIRED UPFRONT FOR THE SHOW.

BOOKING FEE & SHOW PAYMENTS:

For those show bookings made more than 72 hours (3 days) in advance on my online booking calendar using your credit card, you only need to pay my $100 Booking fee in order to reserve your show date and time. However, if you call to book a show within 72 hours of the performance date, full payment is due and payable by credit card at the time of booking.

If paying by Venmo, Zelle or any service other than by credit card, full payment is due and payable at the time of booking the show, regardless of the performance date. Personal or Business checks will not be accepted as payment for either Birthday Party Magic Shows or Booking fees.

In all cases, your final payment is due at the time of my performance.

Fees for my magic show programs do not include extra costs involved with performing at your selected venue. This could include permits, licenses, parking fees, and travel (if the show is hosted outside of Orange County). I will provide you with a price quote for the type of show that you selected that will include any extra costs that may be applicable for your selected venue.

Please note that any shows that would take place 50 miles or more outside of Orange County may require a Booking fee based on the total show cost. In such cases that total amount must be paid upfront in lieu of my standard $100 Booking fee.

CHANGING PERFORMANCE DATES/TIMES:

Scheduling changes within 15 days of the performance date, regardless of reason, will result in the forfeit of your $100 Booking fee, and a new $100 Booking fee will be required to secure a new date (as well as for any additional rescheduling requests beyond that). Similar to my cancellation policy, if another party should book me for your original performance date and within the same timeframe on that date, you may apply your original Booking fee to your rescheduled performance date, or I can fully refund your $100 Booking fee.

CANCELATION POLICY:

Cancelations within 30 days of the performance date will forfeit their $100 booking fee.

This policy is predicated on the fact that there are only so many open dates available (which is why I must require the booking fee), and last-minute cancelations deprive me of the opportunity to book these performances in advance.

However, if you do cancel within 8 to 30 days of the performance date, you may apply your $100 booking fee to reschedule another performance date one time with no extra booking fee if you reschedule your event to take place within the next 3 months. (For example, if you booked a show for August 30th but then cancelled it after August 1st, you would have to rebook your event to take place prior to November 30th in order to use your original booking fee).

If you were then to cancel that rescheduled performance, you would forfeit your original booking fee, and must provide a new $100 booking fee in order to reschedule a third time, and that fee could not be applied to book additional shows if you were to cancel again.

However, as noted previously, if another party were to book me for the same day you originally canceled or rescheduled, and it is within the timeframe of your original booking, your $100 booking fee would be refundable. This exception would also apply to other dates that you canceled or rescheduled.

INSURANCE CERTIFICATES:

You are responsible to advise me if any additional insured insurance certificates may be needed for performing at your event. These could be required by some venues where you might be hosting the event (such as at public parks, community rec. halls, etc.). While there is no charge to you for these certificates, I would need to know at least 7 days in advance in order to be sure I can get your insurance certificate in time for your event.

RESPONSIBILITY FOR ACCURACY OF INFORMATION PROVIDED BY YOU:


You are responsible for the accuracy of all information pertaining to your event as provided to me, Brettso the Great.
Any misinformation so provided, or that you failed to provide me, that would place your event in jeopardy, that was not brought to my attention at least 24 hours prior to the date of the event, would still require full payment of the total balance due.

PARKING AT YOUR VENUE:

If parking near your venue can be difficult to find in your neighborhood, I would ask that you provide me with an adequate parking space on the day of the event. This could be in your driveway or by temporarily parking your car on the street near the venue, then leaving when I arrive and allowing me to take that parking space. If there is a charge for parking at your venue, as previously noted, such costs must either be reimbursed or added to my show cost.


OC REGIONAL PARK SHOW VENUES:

If hosting your party at an Orange County Regional Park, please call me at (714) 392-2270. OC Regional Parks requires a $75 fee to have outside vendors perform in their parks (You are allowed up to two vendors for the $75, with each additional vendor requiring another $25). This fee is paid directly to OC Regional Parks and not to me. You would pay this fee when reserving your rental space with OC Regional Parks.
